Introduction

Thanks for using our products and services ("Services"). The Services are provided by CargoMe.("CargoMe"), located at Mikocheni Rose garden avenue Dar es Salaam Tanzania.

Cargo Me is a Company registered under the laws of the United Republic of Tanzania, with its exclusive business being provision of transportation services by operating and providing you with an efficient mobile application for locating and requesting a rider and respective vehicle for transporting your cargo. This is a Privacy Statement in respect of the Service we provide; the Policy governs the privacy of both - riders and users

Definition of Key Terms

  • App means Cargo Me Application.
  • Cargo to the context permitted under this Policy, cargo means any lawful luggage or belonging of the user transported by the rider or driver.
  • Cargo Me means the geolocation service provider that helps the user to search and request a respective vehicle to carry his cargo.
  • Driver means a person that drives a vehicle that transports the user’s cargo to far destinations including transit routes, it does not include routes within the city or nearby townships. This definition as the context permit, includes the Transporter.
  • Operator means Cargo Me Rider means a driver that offers transportation of the user’s cargo within the city or nearby townships, and it includes the owner of the vehicle.
  • Transporter means the owner of the vehicle used by the driver to transport the user’s cargo.
  • Transportation services means services that are provided by the rider to the user by transporting the user’s cargo.
  • User means any person that uses and is provided with transportation services by the rider requested through the Cargo Me geolocation mobile application.
  • Vehicle means any motor vehicle of any description that is used by the rider or driver to transport the user’s cargo to various destinations

Objective

The central objective of this policy is to introduce both the user and rider to privacy statements of the operator.

Rights for users and riders/drivers

A user and rider/transporter shall have exclusive right of rescheduling and changing the route, provided that rates to be charged by the operator shall be charged depending on the pickup – destination rule, in consideration with other factors as may be determined from time to time.

Subject to the terms and conditions by Cargo Me, users or riders/drivers/transporter are free to register, use the App, and or deregister if so require, provided that no right to access and shall be granted to a non-registered device.

Users, riders, drivers, and transporters shall have the right to change their particulars in their profile for purposes of enhancing a swift provision of services, provided that for riders, change of details in their profile shall be subject to confirmation by the operator.

No right may be claimed by the user under this policy or any part of the terms and conditions, against Cargo Me, except that, general contract between governing users, riders/transporters or drivers shall be entered by themselves in exclusion of Cargo Me.

To that end, Cargo Me shall have the right to claim for its payments and imposed charged pursuant to the provisions of the agreement between her and the rider.

Data Protection

The operator is committed to protect both, users, riders, drivers, and transporters data, to the extent permitted by the law in force in the United Republic of Tanzania. The provisions of the law governing access to information and data protection in Tanzania shall override the provisions of this policy. Data protection under this Policy shall be governed and subject to the provisions of the Access to Information Act, 2016, and the Personal Data Protection Act, 2022. The operator will have full access, with limited control, of the following data: -

  • Rider’s/Driver’s profile
    The rider’s/driver’s profile shall include key identifiers such as driving licence, car details and his contacts. The operator shall not have control over change of such details; however, they will be kept for purposes of reference and operations. Any change of such details shall be communicated to the operator for purposes of efficiency and reference. Except permitted by the law, Cargo Me commits not to disclose the rider’s/driver’s private information in her hands. The right of privacy under this clause shall be subject to the law and cannot be construed to bar authorities from having access to information in accordance with the law
  • Transporter’s profile
    The transporter’s profile shall include detailed information of the transporter including all his vehicles and drivers under his pool
  • User’s profile
    Cargo Me is committed to always protect the user’s information in its hand, as forming part of its profile in the App. However, this shall not be construed to bar authorities from accessing information under the laws in force in the United Republic.
  • Payments
    Cargo Me does not receive direct payments from App users. All payments are directly made to the rider/driver according to the approved and prescribed rates. Charges imposed by the operator (Cargo Me) towards the rider/transporter/driver per trip shall take into account the rates prescribed by the Land Transport Regulatory Authority and business forces in place. To that end, Cargo Me shall remain harmless from any claims concerning payments or any other charges, fines, whatsoever between the user and rider.
  • Correspondences
    All correspondences between the user, rider/driver, or rider/driver/transporter and Cargo Me shall remain confidential as far as permitted by law to be so. Non-disclosure of such information shall remain the primary object, as far as such non-disclosure does not defeat the objectives of the law in force
